These Terms of Service govern your access to and use of BrewUpp.
In these Terms, “BrewUpp”, “we”, “us” and “our” mean Web Upp Limited, trading as BrewUpp.
By creating an account, purchasing a subscription, purchasing credits, or using BrewUpp, you agree to these Terms.
If you do not agree, you must not use BrewUpp.
1. About BrewUpp
BrewUpp is a digital platform that provides access to AI-powered creative tools, including writing, chat, image generation, video generation, audio and code tools.
Features may depend on your plan, available credits, technical limits and third-party providers.
We may update, change, suspend or remove features at any time.
2. Eligibility and accounts
You must be at least 18 years old or otherwise legally able to enter into a binding contract to use BrewUpp.
You are responsible for:
- keeping your account credentials secure
- all activity carried out through your account
- ensuring your account information is accurate and up to date
You must not share your account in a way that breaches your plan or usage limits.
We may suspend or terminate accounts used fraudulently, abusively, unlawfully or in breach of these Terms.
3. Subscriptions, credits and billing
BrewUpp may offer paid subscriptions, credit packs and other paid services.
Paid plans may include recurring charges and monthly credit allowances.
By purchasing, you authorise us and our payment providers to charge the applicable fees.
Unless stated otherwise:
- subscriptions renew automatically until cancelled
- charges are billed in advance
- credits are consumed as you use supported features
- unused credits do not roll over unless explicitly stated
- pricing and features may change for future billing periods
You are responsible for any applicable taxes.
4. Cancellations and refunds
You may cancel your subscription at any time. Your plan will remain active until the end of the current billing period.
Our Refund & Cancellation Policy forms part of these Terms.
Because BrewUpp is a digital service using paid AI processing, refunds are limited once a subscription has started, credits have been added, or services have been used.
Where services are provided immediately after purchase, you may be asked to consent to immediate access and acknowledge that cancellation rights may be affected.
Nothing in these Terms limits your statutory rights.
5. Acceptable use
You must use BrewUpp lawfully and responsibly.
You must not use BrewUpp to:
- break any law or regulation
- infringe intellectual property or other rights
- generate or distribute harmful, abusive, misleading or unlawful content
- create malware, spam or scams
- attempt unauthorised access to systems or data
- interfere with the service or infrastructure
- misuse the service in an excessive or abusive manner
We may restrict or terminate access where misuse is suspected.
6. AI-generated content
BrewUpp uses AI systems to generate outputs based on your inputs.
You understand that:
- outputs may be inaccurate, incomplete or unsuitable
- outputs must be reviewed before use
- BrewUpp does not provide professional advice
- you are responsible for how outputs are used
You should not rely on outputs without appropriate review.
7. Your content
You retain ownership of your content.
You grant us a limited licence to process your content to:
- provide the service
- generate outputs
- maintain and improve the platform
- comply with legal obligations
You confirm you have the rights to use any content you submit.
8. Intellectual property
All rights in BrewUpp (excluding user content) belong to us or our licensors.
You may not copy, resell, reverse engineer or exploit the service except as permitted by law or by us.
9. Availability and third-party services
We aim to keep BrewUpp available but do not guarantee uninterrupted service.
BrewUpp depends on third-party providers (including AI and payment services), and we are not responsible for failures outside our control.
10. Suspension and termination
We may suspend or terminate access if:
- you breach these Terms
- payment fails
- misuse or unlawful activity is suspected
- there is legal or security risk
We are not required to provide refunds where termination results from a breach.
11. Liability
Nothing in these Terms excludes liability where it cannot be excluded by law.
Subject to that:
- BrewUpp is provided “as available”
- we do not guarantee accuracy or suitability
- we are not liable for indirect or consequential losses
- our total liability is limited to the amount you paid in the previous 12 months
Your statutory rights are not affected.
12. Privacy
Our Privacy Policy explains how we handle personal data.
13. Changes to these Terms
We may update these Terms from time to time.
Continued use of BrewUpp means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of England and Wales.
